કચ્છ અને અમદાવાદમાં થયેલ મોબ લીંચિંગ અને મોબ વાયોલન્સ ઘટના બાબતે DGP ને પત્ર લખી ને ગડશીશા કેસમાં IPC ની 307, 302 કલમોનો ઉમેરો કરવામાં આવે અને ગડશીશા પોલિસ ઇન્સ્પેક્ટર અને PSI શ્રીઓ ની ન્યાયહિતમાં તાત્કાલિક જિલ્લા બાહર બદલી કરવામાં આવે જેવી માંગણી કરવામાં આવી.

વિષય- કચ્છ અને અમદાવાદમાં થયેલ મોબ લીંચિંગ અને મોબ વાયોલન્સ ઘટના બાબતે
સાહેબ શ્રી,
આપના ધ્યાનમાં લાવવું કે કચ્છ પશ્ચિમ જિલ્લાના ગઢશીશા પોલિસ સ્ટેશનના દરશડી ગામની સીમમાં હાસમ ઉમર શિરું અને અન્ય મજૂરોને ૧૦ લોકોના સમૂહે ઢોર માર મારેલ જેથી હાસમ ઉમર શિરું મૃત્યુ પામેલ. સાહેબ ઉક્ત ઘટના ૧૮-૪-૨૪ ના રોજ આશરે ૯ વાગ્યા સાંજે થયેલ અને FIR No ૧૧૨૦૫૦૦૬૨૪૦ તા-૨૦-૪-૨૪ ૯.૪૫ સાંજે IPC ની કલમ ૧૪૩, ૧૪૭, ૩૨૩, ૨૯૪(b), ૧૮૮ હેઠળ દાખલ થયેલ છે. સાહેબ FIR દાખલ પોલિસ કરવામાં ૪૮ કલાક સમય લગાવેલ છે અને જાણી જોઈને ને એવી સામાન્ય કલમો લગાવેલ છે કે જે મોબ લીંચિંગ જેવા જઘન્ય અપરાધ કરનાર આરોપીઓ ને કેસમાં સીધો લાભ આપે અને તેમની મુક્તિનો માર્ગ મોકળો કરે.
બીજી ઘટના અમદાવાદ શહેરના ઇસનપુર પોલિસ સ્ટેશન ની છે જ્યાં ૨૧-૪-૨૪ નારોજ બપોરે આશરે ૩ વાગ્યે મોહમ્મદ ફરદીન ભાઈ લસ્સી પીવા જાય છે, જ્યાં નજીવી તકરારમાં લસ્સીની લારી વાળા ફોન કરીને અન્ય માણસો ને બોલાવીને ઢોર માર મરેલ અને તેમનું પાકીટ અને ચાંદીની ચેન પણ છીનવી લીધેલ જેનો ઉલ્લેખ FIR માં છે પરંતુ (પાકીટ અને ચેન ગેરવલ્લે થયેલ છે તેવું લખેલ) ત્યારબાદ તેઓ સારવાર માટે એલજી હોસ્પિટલમાં દાખલ થયા. જેની FIR ઘટનાના ૧૦ કલાક પછી IPC ની કલમ ૩૨૩, ૩૨૪, ૨૯૪(b), ૧૧૪ અને GPA એક્ટ ની ૧૩૫(૧) હેઠળ નોધવામાં આવેલ છે. સાહેબ આ ઘટનામાં પણ લૂટ, જાન થી મારી નાખવાની જેવી કોઈ કલમ લગાવવામાં આવેલ નથી.
સાહેબ શ્રી આપના ધ્યાન માનનીય સુપ્રીમ કોર્ટ ના ચુકાદા WRIT PETITION (CIVIL) NO. 754 OF 2016 Tehseen S. Poonawalla ...Petitioner(s) Versus Union of India and others ની તરફ લાવવા માંગુ છું. આ ચુકાદા મુજબ:
A. Preventive Measures
(i) The State Governments shall designate, a senior police officer, not below the rank of Superintendent of Police, as Nodal Officer in each district. Such Nodal Officer shall be assisted by one of the DSP rank officers in the district for taking measures to prevent incidents of mob violence and lynching.
(ii) The State Governments shall forthwith identify Districts, Sub-Divisions and/or Villages where instances of lynching and mob violence have been reported in the recent past, say, in the last five years.
B. Remedial Measures
(i) Despite the preventive measures taken by the State Police, if it comes to the notice of the local police that an incident of lynching or mob violence has taken place, the jurisdictional police station shall immediately cause to lodge an FIR, without any undue delay, under the relevant provisions of IPC and/or other provisions of law.
(iii) Investigation in such offences shall be personally monitored by the Nodal Officer who shall be duty bound to ensure that the investigation is carried out effectively and the charge-sheet in such cases is filed within the statutory period from the date of registration of the FIR or arrest of the accused, as the case may be.
The said compensation scheme must also have a provision for interim relief to be paid to the victim(s) or to the next of kin of the deceased within a period of thirty days of the incident of mob violence/lynching.
(v) The cases of lynching and mob violence shall be specifically tried by designated court/Fast Track Courts earmarked for that purpose in each district. Such courts shall hold trial of the case on a day to day basis.
(vii) The courts trying the cases of mob violence and lynching may, on application by a witness or by the public prosecutor in relation to such witness or on its own motion, take such measures, as it deems fit, for protection and for concealing the identity and address of the witness.
C. Punitive Measures
(i) Wherever it is found that a police officer or an officer of the district administration has failed to comply with the aforesaid directions in order to prevent and/or investigate and/or facilitate expeditious trial of any crime of mob violence and lynching, the same shall be considered as an act of deliberate negligence and/or misconduct for which appropriate action must be taken against him/her and not limited to departmental action under the service rules. The departmental action shall be taken to its logical conclusion preferably within six months by the authority of the first instance.
સાહેબ શ્રી માનનીય સુપ્રીમ કોર્ટ ના ઉપરોક્ત ચુકાદા મુજબ પોલિસે ભોગબનનાર પ્રતિ અસંવેદનશીલતા બતાવી છે અને આરોપીઓ ની તરફેણ માં કામ કરી રહી છે. જેથી અમારી માંગણી છે કે
૧- દરેક જિલ્લા માં SP રેંક ના અધિકારીને નોડલ ઓફિસર નિયુક્ત કરી મોબ લીંચિંગની ઘટનાઓમાં નિરીક્ષણ સોંપવામાં આવે.
૨- પ્રશાસન દ્વારા એવા ગામો, તાલુકાઓ ની ઓળખ કરવામાં આવે જ્યાં ગયા ૫ વર્ષોમાં મોબ લીંચિંગ/ મોબ હિંસા ની ઘટના બનેલ છે.
૩- ગડશીશા પોલિસ ને FIR દાખલ કરવામાં બેદરકારી દાખવા બદલ વિભાગીય તપાસ કરીને ૬ મહીના ની અંદર સર્વિસ નિયમો મુજબ કાર્યવાહી કરવામાં આવે.
૪- ગડશીશા પોલિસ ઇન્સ્પેક્ટર અને PSI શ્રીઓ ની ન્યાયહિતમાં તાત્કાલિક જિલ્લા બાહર બદલી કરવામાં આવે.
૫-બંને કેસોમાં તાત્કાલિક નોડલ ઓફિસર નિયુક્ત કરવામાં આવે.
૬- બંને કેસોમાં વિકટીમ કંપન્સેશન સ્કીમ હેઠળ સહાય ચૂકવવામાં આવે.
૬- ગડશીશા કેસમાં IPC ની 307, 302 કલમોનો ઉમેરો કરવામાં આવે.
૭- ઇસનપુર કેસમાં IPC ની 307 અને લૂંટની કલમોનો ઉમેરો કરવામાં આવે.
૮- સુપ્રીમ કોર્ટના ચુકાદા મુજબ બીજી જોગવાઈયોનો અમલ કરવામાં આવે.
૯- ગુજરાત પોલિસ દ્વારા સુપ્રીમ કોર્ટના ચુકાદાના અમલીકરણ માટે પરિપત્ર કરવામાં આવે.
૧૦- બંને કેસ માટે ફાસ્ટ ટ્રેક કોર્ટમાં ડે ટુ ડે સુનાવણી થાય માટે પરિપત્ર કરવામાં આવે.
૧૧- બન્ને કેસ ના ફરીયાદીઓ અને સાહેદોની સુરક્ષા કરવામાં આવે.
મને આશા છે કે ન્યાયહિતમાં અમારી ઉપરોક્ત માંગણીઓના અમલીકરણ માટે હુકમ કરશો.
